Lack of control (hinted at in the one currently listed), including the location of open code. (For example, Patriot Act impact on code and data location.)
Reduced choices when available commercial software is equally good or better

Not sure I follow, if the code and/or standards are open, what is the impact of the Patriot Act?

Reduced choices when available commercial software is equally good or better

If you pick a proprietary format, you (usually) have only one choice, so I'm not following the reduced choices idea
