This is an issue someone raised with us in the process of documenting the contents list component as part of the design documentation work:
The contents list is too low in the type hierarchy. It uses the smallest available type size, like the breadcrumb or the footer. This is strange given that it’s used to navigate chapters in a page, and I have an assumption that people don’t always find what they need because of that
